After years of filing lawsuits, the Nirvana Nevermind Baby has lost the case to a US District Judge in Los Angeles.
On September 2, US judge Fernando Olguin dismissed the case noting that it was filed beyond the ten-year statute of limitations. The judge ruled out the case citing Elden ‘waited too long to claim that the band sexually exploited him.’
Due to the recent ruling by judge Olguin, he cannot refile the lawsuit for the fourth time, though he intends to appeal the case.
Previously, in his August 2021 lawsuit against Nirvana, Elden claimed that the image resulted in his ‘loss of enjoyment of life.’ He also argued the decade-long photo caused him emotional distress as his private part was exposed as a baby.
